Residential Real Estate Transactions
If you are buying or selling a home in California, there are several legal requirements that you should be aware of. First and foremost, the seller must disclose any and all “material facts,” or property conditions, that may affect the potential buyer’s decision to purchase the home. Typically, the seller must complete a Transfer Disclosure Statement (TDS) form, which includes crucial information about the property, such as the condition of the roof, floors, insulation, foundation, etc.
Additionally, residential real estate transactions must go through a title company and title insurance company. Sellers are allowed under California law to negotiate with the buyer regarding who will pay for title insurance. Sellers must also use an escrow agent to finalize the sale of the home and may be required to pay a transfer tax.
Whether you are purchasing or selling a home, my firm can help you navigate the process and ensure that the proper steps are carried out for a smooth transaction.
Resolving Real Estate Disputes
Unfortunately, part of owning or renting property is dealing with various disputes that may arise. If you own rental property, you may eventually have to deal with tenant problems. If you are a renter, you have many rights under California law and may be able to take legal action if you are being unlawfully evicted or harassed by a landlord. Homeowners may face property disputes with neighbors and commercial real estate owners may have to deal with all types of issues, ranging from construction disputes to contractor problems to property line disagreements.
My firm can assist you with all of these issues and more. I have helped numerous clients navigate all types of real estate disputes and other related legal issues, and I am prepared to offer you the personalized representation and tireless advocacy you need.
